PUBLIC NOTICE OF BALLOT TITLE

The following “Ballot Title” prepared by the Town of Lakeview town attorney was filed with the Town elections official on July 26, 2022.

Caption:  Prohibits psilocybin-related businesses within Town of Lakeview.

Question: Shall Town of Lakeview prohibit psilocybin-related businesses in the town?

Summary:  Psilocybin is the psychedelic drug found in certain mushrooms. State law allows operation and/or manufacture of certain licensed psilocybin services.  State law provides that a town council may adopt an ordinance to be referred to the voters to prohibit (i.e., ban) the establishment and/or operation of psilocybin-related registered or licensed activities.  Town of Lakeview has adopted an ordinance to prohibit psilocybin-related businesses in the town, subject to voter approval.  Approval of this measure would prohibit the establishment and/or operation of psilocybin manufacturers and/or service centers within any area subject to the town’s jurisdiction.  The proposed ordinance is available for public inspection on the town’s website and at Town Hall.

Town’s elections official has determined that the measure meets the requirements of Section 1 (2)(d) and (5), Article IV of the Oregon Constitution.  The measure election will be held in the Town of Lakeview on November 8, 2022.  Any elector of the Town of Lakeview who is dissatisfied with the ballot title may petition the Lake County Circuit Court to review the ballot title.  The deadline to file a petition to review the ballot title is September 7, 2022.  The Elections Official/Town Recorder must be notified within one day of any petition being filed in the circuit court challenging the ballot title.
